AHMEDABAD: Were Ishrat Jahan and two others shot outside their Indica car and then fired at again after their bodies were placed inside the vehicle?
The scientific evidence in the Ishrat Jahan fake encounter case does not exactly support the testimonies of the witness cops that Ishrat and two others - Javed Shaikh alias Pranesh Pillai and Jishan Johar - were shot while they were sitting in the car.
Only the fourth person, Amjadali Rana, was made to stand outside the car while they were killed.
All witness cops who were involved in the fake encounter and had testified before judicial magistrates, said that Ishrat and two others were sitting in the vehicle when NK Amin, Tarun Barot, Mohan Kalaswa and Anaju Chaudhary opened fire on the Indica car at Kotarpur waterworks. Nijamuddin Saiyed, Mohan Nanji Menat and Ibrahim Chauhan, who were present on the spot, have claimed that they saw their colleagues and superior officers suddenly open fire on the car. All of them have claimed that they went and saw Javed and Ishrat in the front seats and Johar in the back seat.
Interestingly, some policemen like Moti Talja Desai have stated that they did not see the firing first, though they were present at the scene of offence.
All these cops had lied before investigators on two occasions in the past.
Casting doubts on their testimonies, the report by the Forensic Science Laboratory, Ahmedabad categorically states that the holes found on the vehicle and the clothes of the deceased do not match the claims of firing either from outside or from inside.
The analysis report submitted to the SIT on April 15, 2011 by FSL's deputy director B K Mistry reads: "All entry and exit holes found outside the vehicle/ their direction/ numbers, holes found on seats/their direction/number, holes found on backrest and their height from seats - when they are compared with the holes found particularly in Jishan Johar's shirt and banyan, Javed M Pillai's shirt and banyan - many holes in shirts do not match firing that took place from outside or from inside."
Besides, the FSL analysis reflects that many bullets that passed through the clothes of the deceased actually travelled in a downward direction. This does not correspond with the angle of bullets fired on the vehicle. Moreover, those bullet injuries found on the bodies and the holes found in their pants that were at a lower height than the Indica's doors, also do not explain whether the front door was open. This is because only three bullets had passed through the front door.
Seized photos told true story The photographs seized by IGP Satish Verma after raiding the FSL premises in Meghninagar told the story of the encounter as their analysis established how there was no firing from inside the Indica car. Prior to this, the forensic reports never raised doubts on the crime branch's story about an exchange of fire. When asked about this by the SIT and later by the CBI, the forensic expert said that Gujarat cops never asked for a detailed analysis and opinion.
Why were cops sent to Delhi? The statements made by inspectors C J Goswami and V D Vanar raise doubts about the visit of crime branch cops to Delhi on May 20, ostensibly while following a terror suspect at G L Singhal's behest. While Goswami claimed that they had followed 'Jaanbaz' alias Jishan Johar up to Delhi and ultimately lost him, Vanar maintained that they did nothing in Delhi and just waited for instructions that never came. But the chargesheet does not explain how the cops had followed Jaanbaz to Delhi when he was in illegal custody at Gota Housing Colony from the previous month. The CBI report also does not explain why these cops had then gone to Delhi.
